Acceptance of Terms

"PSYFT" is a brand of Aura Services Private Limited, company incorporated under the laws of India. PSYFT makes this website (the "Site"), including all information, documents, communications, files, text, graphics and software available through the Site (collectively, the "Materials") and all services operated by PSYFT and third parties (the "Services") through the Site, available for your use subject to the terms and conditions set out in this document and any changes to this document that PSYFT may publish from time to time (the "Terms of Use").

By using or accessing the Site in any way, including, without limitation, use of any of the Services, downloading of any Materials, or merely browsing the Site, you agree to and are bound by these Terms of Use.

PSYFT reserves the right to change these Terms of Use and other guidelines or rules posted on the Site from time to time at its sole discretion, and will provide notice of material changes on the home page of the Site.After such notice has been posted, your continued use of the Site, or any Materials or Services accessible through it, constitutes your acceptance for the respective changes. Non - compliance with these Terms of Use at your end, shall terminate your authorisation to use this Site and any Materials that you may have downloaded or printed from it must be immediately destroyed.


Intellectual Property

All the Materials, content and Services on this Site and also their selection and arrangement belong to Psyft and are protected by copyright, patent, , trademark and/or other intellectual property laws. Any unauthorised use of the Materials, content or Services at this Site may violate such laws and these Terms of Use. All rights not expressly granted in these terms of use are reserved by Psyft. PSYFT does not grant any express rights to use the Materials and/or Services. You agree not to copy, frame, modify, download, republish, transmit, rent, lease, loan, sell, assign, distribute, license, sublicense, reverse engineer, or create derivative works based on the Site, its' Materials, content or its' Services or their selection and arrangement, without authorization In addition, you agree not to use any data mining, robots, or similar data gathering and extraction methods in connection with the Site.


Managing Content and Communications

Although it is not our intention to do so, PSYFT reserves the right, at its sole discretion, to delete or remove user content from the Site and to restrict, suspend, or terminate your access to all or parts of this Site, at any time (including, without limitation, our good faith belief that you have not complied with these Terms of Use) without prior notice or liability.

PSYFT may, but is not obligated to, monitor or review (i) any areas of the Site where users transmit or post user content, including but not limited to areas where Services are available, and (ii) the substance of any user content.

To the maximum extent permitted by law, PSYFT will have no liability relating to user content arising under the laws of copyright, libel, privacy, obscenity, or otherwise.


User Conduct

In using the Site, including all Services and Materials available through it, you agree:

  1. Not to interrupt/disrupt or interfere with the security of, or otherwise cause harm to, the Site, or any Services, Materials, system resources, accounts, passwords, servers, or networks connected to or accessible through the Site or any affiliated or linked websites;
  2. Not to upload, post or otherwise transmit through the Site any viruses or other harmful, disruptive or destructive files;
  3. Not to create a false identity;

User Registration

Wherever use of the Site or certain Services of the Site require user registration, you will be required to provide certain registration details (the "Registration Data").

In registering to use the Site, including all Services and Materials available through it, you agree to:

  1. Provide correct, accurate, complete and up to date information about yourself as required by the Sites registration form.
  2. Maintain and update your Registration Data to keep it accurate, complete and up to date.

Disclaimer of Warranties

In using this Site and its Services, you expressly understand and agree that:

Limitation of Liability

To the extent not prohibited by applicable law, PSYFT is not liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, revenue, goodwill, use, data, electronically transmitted orders or other economic advantage (even if PSYFT has been advised of the possibility of such damages), however caused and regardless of the theory of liability, whether in contract (including fundamental breach), tort (including negligence) or otherwise, arising out of, or related to:

  2. The cost of procurement of substitute goods and Services purchased or acquired or messages received or transactions entered into though or from the Services;
  3. Unauthorised access to or alteration of your transmissions or data;
  4. Statements or conduct of any third party on the Services or Site;
  5. Any other matter relating to the Services, including content you may download, use, modify or distribute from the Site.

You have the sole responsibility for adequate protection and backup of data and/or equipment used in connection with the Site and will not make a claim against PSYFT for lost data, inaccurate output, re-run time, work delays or lost profits resulting from the use of content.

You agree to hold PSYFT harmless from, and you covenant not to take any legal action against PSYFT for any claims based on using the Site, whether in contract (including fundamental breach), tort (including negligence) or otherwise except where PSYFT is prevented by law from making such exclusions or limitations.

Collection of personal data

In general, you can visit PSYFT websites without telling us who you are and without revealing any information about yourself. However there may be occasions when you choose to give us personal information. Generally this will be for the purposes of:

  • receiving further information from us or;
  • for recruitment, selection and development purposes by potential employers, managing recruitment and HR (human resource) processes and any related purpose where you have consented to the collection.

We do not collect information of our visitors from other sources, such as public records or bodies, or private organisations. We do not collect or use personal data for any purpose other than those indicated above and will ask you when we need information that personally identifies you or allows us to contact you.

If we wish to use your personal information data for a new purpose/reason, we shall ask you for your consent for this new purpose by indicating in a box at the point (on the site) where personal information data gets collected.


Use and disclosure

If in any case we ask you or require you to provide some personal information about yourself for the purposes described above, we will not rent, sell or exchange information about you to third parties except to your employers or potential employers, with your consent, where you would reasonably expect the information to be disclosed or where we are legally required to disclose such information.


Cookies and automatic data collection

We may, automatically log or register personal information or link information automatically logged by other means with personal data of specific individuals. However, we will only use this information to help us respond to queries you may have about our products or services or to tell you about other PSYFT products and services that we think you may be interested in. We will not pass this information on to any third parties. The Internet browser that you use may make use of a feature called a "cookie" to assign identification to your computer. We don't make use of cookies to store personal information or to link any personal information to non-personal data, unless you have agreed to this by selecting the "Remember Me" option, in the first place. If you select this option a cookie will be placed on your computer which will allow our website www.PSYFT.com to recognise you when you return to our website. No personal information will be stored in this cookie.


Log Files

Like most web site providers, we analyse server log files to collect statistical information about how our web sites are used. This type of information or data is collected at an aggregate level only, and includes browser types, platform types, Internet service providers, referring/exit pages, date/time stamps and other broad demographic data. Such data is not linked to any personally identifiable information.


Security

We protect the integrity and quality of your personally identifiable information/data and we implement every appropriate organisational and technical measure to do so. PSYFT operates its' own Internet Data Centre that is designed to keep critical human resource services and data online secure at all times.

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from:

  • Unauthorized access
  • Improper use or disclosure
  • Unauthorised modification
  • Unlawful destruction or accidental loss

Our employees and data processors, who have access to and who are associated with the processing of personal information/data, will respect the confidentiality of our visitors' personal data.

We ensure that your personal data will not be disclosed to State institutions and authorities except if required by law or other regulation.

The PSYFT web sites do not publish content or collect data that is targeted at children.

Requests can be submitted to the above address by printing and completing a Subject Access Request Form. The purpose of this form is to ensure that you give us all the necessary information to enable us to comply with your request. You do not have to use this form, but if you do not you should ensure that all the required information on this form is provided.

Note: The period of 40 days within which the organisation must respond to the request will not commence until we have received a written proof of your identity.

Requests cannot be made by telephone or any other means.

Proof of Identity

Regardless of the original means of request (letter or email), PSYFT will require proof of identity before releasing personal data. This may be provided in the following forms:

  • A paper copy of a bank statement, utility bill or other company letter sent to you, or;
  • A paper copy of your driving license, birth certificate, passport or benefits book.

Proof of identity should be signed and dated by you and sent to the address above with a stamped addressed envelope so that we can send the information that you have requested to you.

What we will send you

You will be sent a paper notification of:

  • Whether PSYFT is processing personal data about you.
  • A description of the data and the purposes of processing the data. (PSYFT does not disclose personal data to 3rd parties so this information will not be included).
  • An explanation of any codes or abbreviations used so as to make the notification intelligible.
  • If we can, information as to the sources of the data.

You may request that the above information is sent to you by email instead.

Period for Responding

Your request will be dealt with:

  • Within forty days of receipt of the request; or if later
  • Within forty days of receipt of fee and the information needed to verify your identity and locate the information that you seek.

Your right to challenge

If at any time you wish to change personal information that is incorrect or wish to have your personal information deleted, please contact us in writing via the address below. Unless personal information is required to be retained by us for administrative or legal reasons, PSYFT will meet such requests at the earliest possible opportunity by deleting or amending your personal information where appropriate.


Complaints resolution

We are committed to providing a fair and responsive system for handling and resolving complaints concerning the handling of personal information. You have a right to complain and to have your complaint handled efficiently if you are concerned about our handling of your personal information. We believe that any complaint that we may receive is a valuable opportunity to improve the services that we deliver to you and to maintain your confidence in our services.

If at any time you wish to file a complaint in respect of the handling, use or disclosure of your personal information by us, you may do so by contacting our Privacy Officer at the address mentioned below.

We aim to investigate and advise you of the outcome of the complaint promptly.

If you are not satisfied with our handling of your complaint, you may contact your local data protection registrar.


Changes to this statement

PSYFT will occasionally update this privacy statement. When we do, we will also revise the "last updated" date at the top of this privacy statement and post notification of change on web site home pages or other places we deem appropriate.
